Surprise Billing and Transparency- Employer Notice Requirements

The Consolidated Appropriations Act, 2021 (CAA), signed into law last year, has introduced new restrictions on “surprise” out-of-network health care charges and new Transparency rules impacting health care providers, insurers and health plans.

Included in the regulations is a requirement to provide a notice, issued in October, 2021, about the new protections with instructions for group health plans and health insurance issuers.  Employers must furnish the disclosure notice for plan or policy years beginning on or after January 1, 2022.

Many of the provisions go into effect on or after January 1, 2022.
